Terms and Conditions

1. Scope and Object

The following Terms and Conditions are intended to regulate access to and use of this website, majericon.com, owned by José Fernando Míguez Veiras, with the tax address Rua do Cardal da Graça, 3, 1170-075 Lisboa, Portugal, tax identification number 264707419, hereinafter referred to as ‘Majericon’, by anyone wishing to purchase through it, hereinafter referred to as the ‘User’.

Product orders must be placed by Users aged 18 (eighteen) or above (individuals under this age must be authorised by their guardians). 

2. Product Information and Content

2.1 All information on price, products, specifications, promotional activities and services may be altered at any time by Majericon.

2.2 It is possible that items are indicated as available but, due to delays in updating the website, purchases made at the same time, errors or stock shortages, they are not. In cases where the product is not available after the order has been placed, the user will be informed by e-mail or telephone of its total or partial cancellation.

2.3 Partial cancellation of an order due to lack of availability does not entitle the cancellation of the entire order, which will remain the same for the items that are available.

2.4 Items marked as “Pre-Sale” can be purchased at the price indicated, but will only be dispatched when available.

3. Responsibilities

3.1 All products and services commercialised in the Majericon online shop are in accordance with Portuguese law.

3.2 Majericon is not responsible for any inconvenience or damage caused to the User by the use of the Internet network, such as service disruption, external intrusion, anomalies caused by computer viruses or any other case of force majeure.

3.3 The data contained in the invoice is the sole responsibility of the User. Once an invoice has been issued, it cannot be reissued with alterations.

4. Consumer Obligations

4.1 The user guarantees to:
i) Provide correct personal data and addresses;
ii) Not use false identities;
iii) Respect the order limits imposed.

4.2 If any of the data is incorrect or insufficient, and for this reason there is a delay or impossibility in processing the order, or possible non-delivery, the responsibility lies with the User, and Majericon declines any responsibility. In the event that the consumer violates any of these obligations, Majericon reserves the right to cancel future orders, block access to the shop, cancel the supply of any other services made available simultaneously by Majericon to the same User; and also not to allow the User future access to any or all services made available by Majericon.

4.3 It is expressly forbidden to use the products and services purchased for commercial purposes, namely for the purpose of reselling goods.

5. Privacy and Protection of Personal Data

5.1. Majericon guarantees the confidentiality of all data provided by Users.

5.2 The personal data identified on the order form having to be provided is indispensable for the provision of the Service. The omission or inaccuracy of the data provided by the User is the User’s sole and entire responsibility and may result in Majericon refusing to provide the Service.

5.3 The User’s personal data will be processed and stored in computerised form and is intended to be used by Majericon within the scope of the contractual and/or commercial relationship with the User and, if authorised by the User, for the communication of promotions.

5.4 Under the terms of the applicable legislation, the User is guaranteed the right to access, rectify, update and cancel their personal data, either directly or upon written request to [email protected].

5.5 The data provided is collected and processed in a secure manner that prevents its loss or manipulation by entities outside Majericon. However, it is possible that the content hosted on the website may be accessed by unauthorised third parties and Majericon cannot be held responsible for such access and/or use and is not protected against possible deviations.

6. Cancellation of orders

6.1 The User may cancel their order by requesting it from Majericon by emailing [email protected] and quoting the order number, which will be accepted provided that the order has not yet been processed.

6.2 Majericon reserves the right not to process orders when it finds any inconsistency in the personal data submitted or observes misconduct on the part of the buyer.

7. Returns

7.1 If you are a consumer, you may exercise your right of withdrawal within 14 (fourteen) days from the day on which you acquire physical possession of the goods. In order to exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unequivocal statement, by sending an e-mail to [email protected].

7.2 In the event of cancellation of this contract, the consumer may choose:
i. Shopping voucher (valid for future purchases at Majericon);
ii. Refund by bank transfer to a specified account.

7.3 Returned products must be in a saleable condition, i.e. in perfect condition. If the items are not in perfect condition, are damaged and not the fault of Majericon, the return will not be accepted and the order will be sent back to the Customer.

8. Intellectual Property

8.1 The contents of the website are the responsibility of Majericon and its intellectual property and may not be copied or reproduced.

8.2 The User recognises that the contents of the website are protected by copyright and related rights, and other applicable legislation.

9. Prices

9.1 Prices are to be stated in Euros, including taxes and duties, taking into account the VAT rate on the date of payment of the order. The amounts referred to correspond to the Publisher’s Price and the Selling Price on the Majericon website, the latter calculated in accordance with the promotions and/or promotional discounts applied.

9.2 Shipping costs are not included in the price of the product.

9.3 Any other costs resulting from sending orders abroad, in particular customs clearance costs, will be the sole responsibility of the customer.

10. Postage and delivery

10.1 The value of the items will be increased by the amount corresponding to the current postage table, in order to cover shipping costs.

10.2 Majericon will always strive to meet the estimated delivery times but, if it foresees any difficulty in meeting the delivery times, it will inform the User of this and offer the option of terminating the contract. By not exercising this right, we assume that the User retains an interest in the order and consents to delivery beyond the stated timeframe.

10.3 Orders are delivered by CTT, by registered editorial mail or CTT Expresso.

10.4 To track an order in progress, the User must go to the CTT website, where they can check the status of the order using the code provided after sending it.

11. Payment

11.1 Majericon offers the User the following payment methods:
i) MB Way;
ii) Bank transfer;
iii) Multibanco reference;
iv) Debit/Credit Card;
v) Paypal.

11.2 Each payment will result in an invoice being issued in the User’s name. It is the User’s responsibility to enter their Tax Identification Number on the purchase form and/or in the customer area.

11.3 The payment deadline will be set at the time the order is placed.

12. Complaints

12.1 The User may submit complaints relating to orders, invoices, customer service or any other matter, via the e-mail address [email protected].

12.2 Majericon is covered by the Electronic Complaints Book.

13. Resolution of a consumer dispute

13.1 The law applicable to this contract is Portuguese law.

13.2 In the event of a consumer dispute, the consumer must resort to the following alternative consumer dispute resolution body: Centro de Arbitragem de Conflitos de Consumo do Distrito de Lisboa.
